We take the protection and confidentiality of personal data of all users of our website very seriously. We are fully committed to protect the information that users provide to us while using our digital assets. Furthermore, we undertake to protect and use your data in accordance with applicable law.

We process your personal data only to the extent permissible under the EU GDPR (General Data Protection Regulation) and the BDSG (German Federal Data Protection Act).

This Privacy Policy explains our activities regarding the collection, use and disclosure of any personal information collected while using our digital assets when you access these services using your devices.

What data do we record?

An overview of the data than can be collected:

  • Non-personal Data. Unidentified and unidentifiable information that you provide during the visiting process of our website or that is collected through the use of our services. Non-personal data does not allow any conclusions to be drawn to whom the data relate to. Non-personal information that we collect consists primarily of technical and aggregate usage information.

If we combine personal with non-personal data, we treat them as personal data as long es they exist in combination.

The most important methods we use to collect data are listed below:

  • We collect data as soon as you use our services. Once you visit our digital assets and use services, we can collect, record, and store the usage, internet-sessions and related information.

  • We collect data that you provide to us yourself, for example when you contact us directly via a communication channel (e.g. an e-mail containing a comment or feedback).

  • We may collect data from third-party sources as described below.

  • We collect data that you provide to us when you register with our services via a third-party provider such as Facebook or Google.

Why do we collect data?

Recorded data serve the following purposes:

  • to provide and operate our services;

  • to develop, adjust and improve our services;

  • to react to feedback, requests and requirements and offer help;

  • to analyze requirement and usage patterns;

  • for other internal, statistical and research purposes;

  • for us to improve our data security and fraud prevention options;

  • to investigate violations and to enforce our terms and conditions as well as to comply with applicable law, regulations and official orders;

  • to provide you with updates, news, promotional material, and other information related to our services. For advertising emails, you can decide at any time if you want to continue receiving these. If not, you may simply click the corresponding link in these emails.

Who will data be passed on to?

We can pass on your data to our service providers to offer and operate our services (e.g., saving of data via third-party hosting-services, supplying technical support etc.).
 

We may also disclose your information under the following circumstances: (i) to investigate, detect, prevent, or take action against unlawful activities or other misconduct; (ii) to establish or exercise our rights of defense; (iii) to protect our rights, property, or personal safety and the safety of our users or the public; (iv) in the event of change of control at our company or one of our affiliated companies (by way of a merger, acquisition or purchase of (essentially) all assets, etc.); (v) to collect, hold and/or manage your data using authorized third-party providers (e.g. cloud service provider), insofar as this is appropriate for business purposes ; (vi) to work with third-parties to improve your user experience. To avoid misunderstandings, we would like to point out that we can transfer or pass on or otherwise use non-personal data to third-parties at our own discretion.

We will not pass on your email address or other personal data to advertising companies or advertising networks without your consent.

Where is the data saved?

Non-personal data:
Please not that our cooperating companies, as well as our trusted partners and service providers are located around the world. For the purposes outlined in this Privacy Policy, we store and process all non-personal data that we collect in different legal systems.
 

Personal data:
Personal data may be maintained, processed, and stored in the United States, in Ireland, South Korea, Taiwan, Israel and to the extent necessary for the proper provision of our services and/or required by law (as further explained below) in other jurisdictions.

How long will the data be saved?

The data collected will be stored as long as it is necessary for us to provide our services, to comply with our legal and contractual obligations to you, to resolve disputes and to enforce agreements.

We shall correct, supplement, or delete incorrect or incomplete data at our own discretion at any time.

How is the data protected?

The hosting service for our digital assets provides us with the online platform through which we have the ability to offer you our services. Your data may be stored via data storage, databases, and general applications of our hosting provider. Your data is hereby stored on secure servers behind a firewall. Our hosting provider offers secure HTTPS-access to areas of its services.
 

Notwithstanding the measures and efforts taken by us and our hosting provider, we cannot and will not guarantee the absolute protection and security of the data that you upload, publish or otherwise pass on to us or others.

For this reason, we ask that, whenever possible, you do not provide us or others with confidential information that you believe could significantly or permanently harm you if disclosed. In addition, because e-mail and instant messaging are not considered secure forms of communication, we ask that you do not share confidential information through either of these communication channels.
 

All requests and applications we receive by e-mail are of course treated with the utmost care and we shall do everything possible to store this data in a secure manner.

Data processing on social media platforms

We are represented in social media networks in order to present our organization and our services there. The operators of these networks regularly process their users' data for advertising purposes. Among other things, they create user profiles from their online behavior, which are used, for example, to show advertising on the pages of the networks and elsewhere on the Internet that corresponds to the interests of the users. To this end, the operators of the networks store information on user behavior in cookies on the users' computers. Furthermore, it cannot be ruled out that the operators merge this information with other data. Users can obtain further information and instructions on how to object to processing by the site operators in the data protection declarations of the respective operators listed below. It is also possible that the operators or their servers are located in non-EU countries, so that they process data there. This may result in risks for users, e.g. because it is more difficult to enforce their rights or because government agencies access the data.

If users of the networks contact us via our profiles, we process the data provided to us in order to respond to the inquiries. This is our legitimate interest, so that the legal basis is Art. 6 para. 1 s. 1 lit. f GDPR.

No data acquisition of minors

We maintain a profile on LinkedIn. The operator is LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland. No data acquisition of minors

These services are not designed for users who have not reached the legal age of majority. We will not knowingly collect information from children. If you are under the age of majority, you should not download or use the services or provide us with any information.

We reserve the right to request proof of age at any time of the interaction so that we can verify whenever minors are using our services. In the event that we become aware that a minor is using our services, we may prohibit such users from accessing and block our services. We may delete any information we have collected about such users up until this point. If you have reason to believe that a minor has disclosed data to us, please contact us as explained above.

We will only use your personal data for the purposes set out in the Privacy Policy and only if we are convinced that:

  • the use of your personal data is necessary to perform or conclude a contract (e.g. to provide you with the services yourself or to provide customer service or technical support);

  • the use of your personal data is necessary to comply with relevant legal or regulatory obligations, or

  • the use of your personal data is necessary in order to support our legitimate business interests (provided that this is done in a way that is proportionate and respects your data protection rights at all times).

We do not sell users‘ personal information for the intentions and purposes of the CCPA.

As a resident of the EU, you can:

  • request confirmation as to whether or not personal data concerning you is being processed and request access to your stores personal data and to certain additional information;

  • request the receipt of personal data that you have provided to us in a structured, common and machine-readable format;

  • request the correction of your personal data that is stored by us;

  • demand the deletion of your personal data;

  • object to the processing of your personal data by us;

  • request the restriction of the processing of your personal data, or

  • file a complaint with a supervisory authority.

In the course of providing the Services, we may transfer data across borders to affiliates or other third parties and from your country/jurisdiction to other countries/jurisdictions around the world. By using the services, you consent to the transfer of your data outside the EEA.

Your continued use of these services after we have posted a notice of change on our website will constitute your acknowledgement and consent to the changes in the Privacy Policy. At the same time, it is your agreement to be bound to these terms of any changes.
